General terms and conditions of business

1. Scope of Application

1.1 These General Terms and Conditions apply to all orders placed by consumers and businesses through Bela Jewelry’s online shop.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or self-employed professional activity. A business is a natural or legal person, or a partnership with legal capacity, acting in the exercise of their trade, business, or self-employed professional activity when entering into a legal transaction.
1.3 Any deviating terms and conditions of the customer shall not be recognized unless we have expressly agreed to their validity in writing.

3. Offer and Conclusion of Contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
3.2 By clicking the button “Buy,” “Buy Now,” or another similarly clearly labeled button, you submit a binding offer to purchase the goods contained in the shopping cart. For online orders, the order button must clearly indicate the obligation to pay.
3.3 The contract is concluded as soon as we accept your order by means of an order confirmation sent by email or by dispatching the goods.
3.4 The automatic order confirmation merely documents receipt of your order and does not yet constitute acceptance of the contractual offer.

4. Prices and Shipping Costs

4.1 All prices are final prices in euros and include statutory VAT where applicable.
4.2 Shipping costs are charged in addition to the stated product prices. The shipping costs are shown separately during the ordering process. Further information on shipping costs and delivery conditions can be found on our “Shipping” page.
4.3 For deliveries to countries outside the European Union, additional costs may arise, such as customs duties, taxes, or bank charges. These costs shall be borne by the customer.

 

5. Payment

5.1 The payment methods displayed in the shop are available to you during the ordering process.
5.2 The purchase price is due immediately upon conclusion of the contract unless otherwise stated for the respective payment method.
5.3 If certain payment service providers are selected, their additional terms and conditions shall also apply.

 

6. Delivery and Shipping

6.1 Delivery shall be made to the delivery address specified by you.
6.2 Information on delivery times can be found on the product pages or during the ordering process.
6.3 If not all ordered products are in stock, we shall be entitled to make partial deliveries insofar as this is reasonable for you.
6.4 If the ordered product is unavailable, we will inform you without undue delay. Any payments already made will be refunded immediately in such case.

 

7. Retention of Title

 

The goods remain our property until full payment has been made.

8. Right of Withdrawal for Consumers

8.1 Consumers generally have a statutory right of withdrawal of 14 days in the case of distance selling contracts.
8.2 Details of the right of withdrawal are set out in our cancellation policy, which is provided separately on our website.
8.3 The right of withdrawal may be excluded in legally regulated exceptional cases.

 

9. Returns

9.1 Returns shall be made in accordance with the information contained in our cancellation policy and our return instructions.
9.2 Unless otherwise agreed, the customer shall bear the direct costs of returning the goods if this has been communicated accordingly in the cancellation policy.
9.3 A return may not be refused solely because the original packaging is missing.
9.4 Returns should, where possible, be made in suitable packaging in order to avoid transport damage.

 

10. Liability for Defects

The statutory liability for defects shall apply. For consumers, the limitation period for claims relating to defects is two years from delivery of the goods.

11. Vouchers and Gift Cards

11.1 Vouchers and gift cards may only be redeemed to the extent stated and within the communicated validity period.
11.2 Cash payment of vouchers or gift cards is excluded to the extent permitted by law.
11.3 In the event of loss, theft, or unauthorized use of vouchers or gift cards, we shall not assume liability unless a statutory basis for liability applies.

 

12. Liability

12.1 We shall have unlimited liability for intent and gross negligence as well as for damages resulting from injury to life, body, or health.
12.2 In the event of a slightly negligent breach of essential contractual obligations, we shall only be liable for the foreseeable damage typical for the contract.
12.3 Otherwise, liability is excluded to the extent permitted by law.

 

13. Dispute Resolution

We are [not willing / willing] to participate in dispute resolution proceedings before a consumer arbitration board.

14. Final Provisions

14.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions provide otherwise.
14.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships with us shall be our registered place of business.
14.3 Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provision.
